As result <br />or chat consultation. the following Stipulation was attached to the permit <br />Stipulation No. 59 <br />PARTIAL APPROVAL FOR PERMIT REVISION NO. 4 (PR-0~1), FOR THE FOIDEL CREEK MINE IS <br />CONDITIONAL UPON RESOLUTION OF THE PITTSTON COtviPREHENSI VE SETTLEMENT AGREEMENT <br />THAT COVERS THE VIOLATIONS OF A & D COAL, BLACK GOLD COAL, ELKINS ENERGY, ELKINS COAL, <br />GOLDEN CHIP COAL, BROTHERS COAL, D 8 J COAL, JANICE Iv1AR1E COAL, AND GLORY COAL. PROOF <br />OF RESOLUTION OF THIS COtviPREHENSIVE AGREE1vtENT MUST BE SUBMITTED TO THE DIVISION AS <br />SOON AS IT BECOMES AVAILABLE. <br />On June 27, 2000 Twentymile Coal Company submitted a copy of the settlement agreement between the Office of <br />Surface Mining and Reclamation and the Pittston Coal Company, its successor entities, subsidiaries and its <br />affiliates. This settlement agreement was signed by both OSIvt and Pittston representatives on July 19, 1996. This <br />settlement agreement adequately resolves Stipulation No. 59. Stipulation No. 59 has been complied with. <br />Section A -Rule 2.07.6 <br />1. The permit application is accurate and complete. All requirements of the Act and these rules have been <br />complied with (2.07.6(2)(a)). <br />2. Based on information contained in the permit application and other information available to the Division, the <br />Division finds that surface coal mining and reclamation can be feasibly accomplished at the Foidel Creek Mine <br />(2.07.6(2)(b)). <br />3. The assessment of [he probable cumulative impacts of all anticipated coal mining in the general area on the <br />hydrologic balance, as described in 2.05.6(3), has been made by the Division. This assessment entitled <br />"Yampa River CHIA" (revised June 2000) is available for inspection at the offices of the Division. <br />4. A brief summary of the Probable Hydrologic Consequences of [he Foidel Creek Mine follows. Detailed <br />discussion of the Probable Hydrologic Consequences can be found in the approved permit application: <br />Ground water <br />Several possible effects to the ground water system have been identified. <br />Dewaterin¢ and ootentiometric drawdown in bedrock units <br />Dewatering will occur in the Wadge overburden, possibly out as far as the outcrop around the margins of the <br />basin. Dewatering will occur in the Twentymile sandstone above the area of active mining. Drawdown will occur <br />in the Trout Creek sandstone if communication with the mine is established through fault zones. tvlonitoring data <br />indicates Wadge overburden dewatering is occurring as predicted. Twentymile sandstone wells show minimal <br />dewatering at this time.
