EEOwever, if no such provision exists, <br />the only apparent means of obtaining a bond would be to <br />request Robinson to voluntarily provide the same to the <br />City. <br />Although the Board is authorized to require a maximum <br />surety of only $2,500, it does have the ability to require <br />the operator to complete the entire reclamation plan. In <br />the event the operator fails to do so, the Board has the <br />authority to issue, cease and desist orders, request the <br />Attorney General to bring suit for a temporary restraining <br />order, temporary injunction or permanent injunction, require <br />the violator appear before the Board, and suspend, modify or <br />revoke the permit. In addition, the Act provides for civil <br />penalties of $50.00 to $200.00 per day of violation in the <br />event the operator is in noncompliance. This enforcement <br />possibility should not be overlooked since, as a practical <br />matter, it is rather unlikely Robinson would be financially <br />unable to complete reclamation at the site. <br />-8- <br />
