EEOwever, if no such provision exists,
the only apparent means of obtaining a bond would be to
request Robinson to voluntarily provide the same to the
City.
Although the Board is authorized to require a maximum
surety of only $2,500, it does have the ability to require
the operator to complete the entire reclamation plan. In
the event the operator fails to do so, the Board has the
authority to issue, cease and desist orders, request the
Attorney General to bring suit for a temporary restraining
order, temporary injunction or permanent injunction, require
the violator appear before the Board, and suspend, modify or
revoke the permit. In addition, the Act provides for civil
penalties of $50.00 to $200.00 per day of violation in the
event the operator is in noncompliance. This enforcement
possibility should not be overlooked since, as a practical
matter, it is rather unlikely Robinson would be financially
unable to complete reclamation at the site.
-8-
