Because we were not shown the plans until after the <br />pre-bid meeting, and we could no[ comment on the design plan untiljust prior [o the <br />award of the contract, there was no opportunity to make meaningful suggestions anti; <br />actually too late in the process. <br />Because we believed that the road design was excessive and that considerable funds were <br />going to be wasted, and because we believed that John Nelson had failed miserably when <br />he was the supervisor of the original reclamation performed by the Division with the bond <br />monies, we made what David Berry refers to as signiScant concerns in the letter of <br />notification (a copy is enclosed) of termination of the road construction and termination of <br />and of the Division's future reclamation ofthe azea. <br />We attempted to present some facts of the matter [o Mike Long (a copy of that letter is <br />enclosed) and asked for a meeting with the Mined Land Reclamation Board. We have <br />been notiSed that our request has been granted for May 24, 2000. So faz, the Division has <br />not been able to give us an approximate time that day. We would like for the Office of <br />Surface Mining to also attend this meeting at which we are going to ask for a <br />determination of the future responsibilities ofthe Division and whether the Division has <br />any other responsibilities. If there is insufficient time for your Office to make <br />arrangements to attend, we would like to ask for a delay to another month. Please let us <br />know if you would be willing to attend and whether May 24th is convenient.
