Box 1821 <br />Colorado Springs, CO 80901 <br />RECEIVED <br />'JUN 2 7 2000 <br />Division of Minerals 8 Geology <br />Re: Citizens Complaint #CC-00-140-001, GEC Mine, Colorado Division of Minerals and <br />Geology (DMG) Permit C-81-037 <br />Dear Mr. Corley, <br />The Office of Surface Mining (OSM) received your written complaint dated May 24, 2000 on <br />May 24, 2000. Also on that date, Mr. Henry Austin and I attended the Colorado Mine Land <br />Reclamation Board ac your request. Your presentation to the Board regazded issues raised in the <br />written compliant. Following your presentation to the Board, we met with you and your family <br />to discuss your complaint and get some additional background information. <br />The OSM Denver Field Division (DFD) also received a letter from Ms. Anne Corley, Secretary <br />and Treasurer of The Corley Company, dated May 15, that was received by the OSM <br />Albuquerque Field Office on May 22, and forwazded to this office. The May 15 and May 24 <br />letters address the same issues and were both considered during review of this complaint. As a <br />point of clarification, responsibility for oversight of the Colorado coal program was transferred to <br />DFD in 1995. Any additional complaints or correspondence you have should be directed to this <br />office. <br />On June 5, DFD received a third letter from you dated May 30. This letter was offered as <br />clarification of your complaint, but actually raises three new issues not previously addressed. On <br />June 6, DFD received a fourth letter from you offering additional information about off-site <br />impacts you identified in your May 30 letter. All four of your letters aze being handled as one <br />citizen complaint. For tracking purposes, your complaint has been assigned the number CC-00- <br />140-001. <br />The Surface Mining Control and Reclamation Act (SMCRA), and it's implementing regulations, <br />established nationwide minimum standards, in part, for coal mining operations and standards by <br />which a state could elect to administer this Federal law. OSM approved the Colorado program as <br />meeting SMCRA's minimum standards in 1981 and DMG became the primary regulatory <br />authority. OSM's role is to ensure that Colorado is administering and enforcing its program in <br />accordance with SMCRA and the terms of the approved program. <br />
