Long <br />Division Director <br />I just wanted to take this opportunity to follow up on the conference telephone call held last <br />week between you, me, Colorado Assistant Attorney General Steve Bmwn, and Frank <br />Bartlett of Trinidad Basin Mining Company. <br />I have enclosed, per your request, a copy of the letter transmitted from our offices to the <br />Department of Adrt+in;cL,ation regarlding the collection of $10,750.00 in outstanding civil <br />penalties owed the State of Colorado by Trinidad Basin Mining Company. <br />With regard to your office's questions about the development of a final reclamation plan for <br />the Trinidad Basin Mine, the Division met with Mr. Frank Bartlett and Mr. Greg Lewicki, <br />representatives for Trinidad Basin Mining Company, on September 1, 1993 at the mine site. <br />At the conclusion of that inspection, the Division and Trinidad Basin Mining Company were <br />in agreement as to what would be reclaimed, save for three ponds situated along an access <br />mad in Section 22, and with possible illegal mining disturbances in Section 15. <br />Since that meeting the Division has determined that the disturbances in Section 15 are not <br />attributable to Trinidad Basin Mining Company, and as such will not be reclaimed with <br />monies fmm the forfeited Trinidad Basin Mining Company bonds. The Division has further <br />determined that leaving the access mad into Section 22 as it is now, with some minor <br />repairs, rather than reconfiguring it to We contours of the hillside, will reduce the cost of the <br />reclamation, while at the same time leave ponds for use by livestock and wildlife per the <br />approved post-mining land use. This cost reduction will further afford the Division the <br />opportunity to better address the realignment of the north-flowing surface water runoff that is <br />currently impacting the Del Ague bridge. <br />Leaving the road embaril®ents across the two drainages in the east half of Section 22 will <br />necessitate the development of a slope stability analysis by an independent subcontractor, to <br />
