The permittee reported recent exceedences of the permit limitations <br />that may or may not be permit violations. As you may be aware, there is <br />concern whether discharge from outfall 004 reaches state waters. Karl Koehler <br />(527-4135) has indicated that you suggested a field support representative <br />visit the site. The information furnished by the permittee when the permit <br />was drafted indicated that discharge went to an unnamed ditch. It was assumed <br />that this was a direct discharge. Mr. Koehler has indicated that no ditch <br />exists in the vicinity of outfall 004. The recent discharge about which. he <br />spoke to you and me ran across an open field and dissipated into the ground <br />without leaving mine property. Mr. Koehler stated that a larger flow could <br />potentially reach the North Fork of the Gunnison River, but it is unclear <br />whether this would occur as a point source or as sheet flow. <br />I am requesting chat you determine: 1) where flow from outfall 004 would <br />likely go; 2) if it reaches state waters - whether it would be as a point <br />source or sheet flow and, finally, 3) your opinion as to whether discharges <br />from this point are actually point sources discharges to state waters.
