Concerning: Corey Gravel Pit #3, Permit M-1987-024 (Montrose County)
Request for additional time allowed for Mr. Corey to provide a larger
financial warranty for this Permit.
Dear Mr. Oswald:
In response to the recalculation the reclamation bond for this facility done on 3/28/01, I
am requesting an extension of time allowed to provide the increased financial warranty
amowrt.
As you know, United Companies is leasing the Corey Pit #3 from Mr. Corey. When the
Notice of Bond Increase was received, Mr. Corey asked me if he or United Companies
would pay for the Reclamation Bond. I responded that United Companies would pay for
the bond. I said this based on my assumption that United Companies had been providing
the bond as part of our lease anailgement.
In fact Mr. Corey, the landowner and pemlit holder, has provided the financial warranty
for this permit. United Companies is not able to obtain a bond in this situation. The gravel
pit site is no[ owned by our company. The Reclamation Permit is not in our Hanle. It is
much better from a legal point of view that Mr. Corey provide the financial warranty in
ftric ('$$P„
Mr. Corey is willing [o provide the financial warranty. He has contacted the bank [hat
issued the original Letter of Credit and has begun the process of obtaining a replacement
in the amount of $18,670.00. The bank expects this process to take 3 weeks.
1 know that the reason Mr. Corey will probably not be able to meet the May 29, 2001
deadline for providing the new financial walTanty is because of the statement that I made
to him saying that United Companies could provide it. He should not be penalized for
listening to me in a situation when I didn't have the facts straight.
