D.
Mr, David C, Shelton, Director
Colorado Mined Land Reclamation Division
423 Centennial Building
1313 Sherman Street
Denver, Colorado 80203
Dear Mr, Shelton:
December 28, 1982
Enclosed is a copy of my formal objection to the issueance of
permit C-041-81. I have delayed filing this objection because
Mr, Greenlee has continually assured me that a settlement would
be reached based on the appraisal made by Frank Nisley Jr. There
are two subsidence areas involved; one mined by GEX prior to
January 1982 and the other mined by Western after that date,
Nisley calculated that the damage due to subsidence by Western
was $78,683 - Mr. Greenlyhas offered me only $30,689. Using
Mr, Nisley's figures on the area mined by GEX the subsidence
damage was $35,007 - I was offered $8,034.
I still hope that Western Associated Coal Corp will honor its
agreement and I would appreciate your holding the enclosed formal
objection until just before the filing deadline. I plan to be
in Denver on January 3rd, to meet with either yourself or Jim
Herron.
Sincerely,
Paul B, Alexander
