I~elieve <br />addresses the requirements of stipulations 33 and 34 <br />Additionally, Metcalf will return this spring to continue e <br />excavation of site 5RT345 as per the plan. As you can see there <br />has been close coordination between Metcalf, the BLM and the SHPO <br />on this project. <br />The attached copy of the special use permit addresses the <br />requirement of stipulation 35. Please note that the special use <br />permit covers both the southwestern and eastern mining districts. <br />Therefore, some of the stipulations placed in the special use <br />permit do not apply to the southwestern mine district. <br />In reference to stipulation 36, the attached recording memorandum <br />demonstrates that Twentymile has the ability to undermine and <br />subside the Robert Perry property. Progress continues with the <br />other parties for obtaining the appropriate approvals prior to <br />longwall mining. It should be noted that Cyprus Western Coal <br />Company is the owner of the gas well and no further agreements are <br />needed by Twentymile to impact the well. The well will be plugged <br />in the next couple of weeks per the State Oil and Gas Commission <br />requirements. Once plugged Twentymile will be able to mine near <br />the well in compliance with MSHA regulations. <br />crnRUs <br />
