The reason for this <br />action is due to the fact that we have received notice from Mr. <br />A. A. Hanson. Authorized went for Heather Land & Cattle Company. <br />that access through their property is no longer permitted. <br />The Fremont County Regulations provide for suspension of your <br />permit in Section ti0U B 3',c (t) page 115. The regulations state <br />the following: <br />" The approval of a conditional use permit shall be deemed <br />suspended upon the expiration or termination of the permit <br />holder's right to possession of the permit site, or if any <br />other required permit expires or is terminated or revoked, <br />which suspension shall continue until the permit holder <br />reinstates or renews ~uch right to possession or ny required <br />permit. Pi-c~vided. however. no period of suspension shall <br />extend beyond the terrh of the permit or any extension there- <br />of . ' <br />Without access to the property you do not have possession to the <br />property therefore the suspension. <br />It shall be required that ,prior <br />etc. that this access problem be <br />with an agreement. letter, permit <br />~< be granted for the remaind~r of <br />on or before January 1j. 1 94. <br />y <br />to any further mining, hauling <br />resolved by eithez- providing me <br />etc. stating that access will <br />the Conditional Llse Permit term, <br />At the Commissioner meeting the Board x-equested that this item be <br />rescheduled for their Janu~ry meeting to determine if any further <br />action is necessary. <br />It should also be noted that, if any mining activity takes place <br />prior to obtaining adequate access, procedures for revoking your <br />permit will be initiated. <br />:*. <br />.ilk <br />
