Lamm <br />Governor <br />Date <br />To: <br />November 12, 1985 /' <br />Linda White /L_,l//l`r <br />From: Dan Mathews <br />Re: Status of Permit for CYCC Mine No. 1, Mine No. 2 and Eckman Park - <br />File No. 79-177 <br />As you are aware, we received a letter from Robert Hagen of OSM on August 19, <br />1985, which questioned Colorado Yampa Coal Company's authority to operate <br />under interim Permit No. 19-177. Mr. Hagen requested that we provide to OSM <br />information on the status of the permit and our proposed action regarding the <br />permit. Outlined below is a brief history of Permit No. 79-177, and our <br />proposed action. <br />Energy Fuels Corporation (previous owner) originally filed an application for <br />Eckman Park, Energy No. 1 and 2 MInes in September, 1979. A joint review was <br />conducted by MLR and OSM. The application was reviewed under the federal <br />permanent program regulations 30 C.F.R.701, et. seg.. The Division issued <br />Permit No. 79-177 in March, 1980, with seven stipulations. Concurrently, OSM <br />made a finding of compliance with the 30 CFR Part 211 and the Permanent <br />Program Regulations. A Technical Environmental Analysis (TEA) was prepared by <br />OSM in support of their decision to approve the mining and reclamation plan <br />and a determination of no significant impact was made. <br />The Colorado permanent program was approved on December 15, 1980. All <br />existing operations were required to submit an application pursuant to the <br />state program. The Division determined that Permit No. 19-177 fell within the <br />scope of Rule 2.01.3(5) which allowed the applicant to effect compliance by <br />submitting revisions or modifications that addrssed substantive differences <br />between the State Program and the Federal Permanent Regulations by December <br />15, 1981. <br />Colorado Yampa Coal Company submitted a State Program Compliance Package on <br />December 14, 1981. The information was reviewed by the Division and a number <br />of concerns were identified. With submittal of certain information on <br />Decmeber 20, 1982 all concerns had been satisfactorily addressed. A permanent <br />program permit could have been issued at that time, but was not. Since that <br />time MLRD also conducted a mid-term review and subsequently has verified <br />compliance with the permanent program. <br />It is proposed that to resolve the situation and address OSM's concern, a <br />Permanent Program Permit back dated to December 20, 1982 be issued to Colorado <br />Yampa Coal Company. <br />srs <br />iiiiiiiiiiiiiiiiiii <br />V~ <br /> <br />42 33Centennial Building, 1313 Sherman Street Denver, Colorado 80203 Tel.
