<br />As stated in the Application for Amendment Number 6 and in Golder Associates' letter of April <br />13, 1994, an angle of internal friction of 24 degrees was used for the design. Thus the design <br />is conservative in comparison to the test data. <br />It is CC&V's belief that the provision of these results to the OMLR constitutes completion of <br />this commitment because the original design is based on more conservative criteria. Therefore <br />no redesign is required and therefore the possible limitation on leach pad construction beyond <br />the foundation as stated in the subject commitment is no longer operative. We would appreciate <br />confirmation of this conclusion at the OMLR's earliest convenience.
