St., Rocm 215 <br />Denver, CO 80203 <br />Attn: Anthony Waldron <br />Re: Keenesburg Strip Mine, File No. C-81-028 <br />Dear Mr. Waldron: <br />Thank you for your letter dated March 1, 1995. <br />We have carefully reviewed our permit and the applicable <br />regulations and, for the reasons which follow, do not believe a <br />technical revision is triggered by our change to a different coal <br />supply. <br />As you know, a "technical revision" means "a minor chancre.. to the <br />terms or requirements of a permit...." Except for Stipulation No. <br />24, Permit No. C-81-028 is silent on the source of coal. The <br />permit neither requires nor prohibits the disposal of ash from any <br />specific coal source. Thus no chance to the permit's terms or <br />requirements is necessary to accomodate ash from a new source of <br />coal, and consequently, a technical revision is not warranted. <br />We do acknowledge however, Stipulation No. 24 which requires us to <br />collect and analyze ash samples whenever a source of coal is <br />changed.
