-2-
Stipulation No. 50 requires that an archaeological study of the 5674-acre
addition to the original mine permit area, added by Permit Revision No. 1, be
performed before mining occurs in that new area. No mining has occurred in
this area to date. Question 2C (page 8) of the Midterm Review incorrectly
stated that the stipulation applied to the entire area north of the Purgatoire
River. This was incorrect because part of the original permit area exists
north of the river also. Mining may proceed within the original permit area
boundaries, including that portion of the original area that lies north of the
river, without the permittee having to comply with Stipulation No. 50.
Stipulation Nos. 51, 52, and 53 were part of the June 1990 Midterm Review.
All three stipulations involve secondary, or retreat, mining in Wet Canyon.
As of this date, mining has not occurred in this area as well. The
easternmost extension of mining occurring north of Highway 12 lies about 1 1/2
miles west of Wet Canyon.
The Division appreciates the input from your office concerning our most recent
Midterm Review of the Golden Eagle Mine.
