Colorado 81625 Mined Land
Reclamation Division
RE: Colorado Mined Land Reclamation Board
Dear Mr. Eilts:
This is in response to your letter of April 18, 1991 alleging
violations of your lease with Sun Coal Company and complaining of
the action taken by the Mined Land Reclamation Board (MLRB).
In your letter you state that Sun Coal has failed to comply with
the terms of a Routt County District Court order enforcing your
lease with Sun Coal. However, this office does not enforce
leases or court orders involving disputes between private par-
ties. If you wish to pursue any cause of action that you may
have against Sun Coal I suggest that your retain private counsel.
In your letter you also complain about the terms and implementa-
tion of Sun Coal's approved reclamation plan. The reclamation
plan was approved by the MLRH at a hearing, which you attended,
several years ago. Irr February 1991 you presented your concerns
to the MLRB but the MLRB denied your request for relief. I again
advise you to consult an attorney if you are not satisfied with
the MLRB's decision in this matter.
Sincerely,
FOR THE ATTORNEY GENERAL
~~-
FRANL~~ F~OHNSON
Assistant Attorney General
Natural Resources Section
(303) 620-4700
