COVERAGE UNDER TffiS PERMIT <br />Authority to Dischazse <br />Under this permit, active and inactive metal training operations, and thine-waste remediation projects at inactive mine <br />sites, where stormwater has come into contact with any overburden, raw material, intermediate products, byproducts, <br />fmished products or waste products located at the mining site, aze permitted to dischazge stormwater associated with <br />those operations into waters of the state of Colorado. The term mitring operation includes active and inactive mining <br />activities. <br />2. Industries Covered Under this Permit <br />a. Types of Activities Covered by this Permit: <br />1) This permit authorizes all new and existing dischazges composed entirely of stormwater associated with <br />active and inactive metal mining operations. (See Rationale, Section IV for an explanation of exemptions for <br />uncontaminated stormwater and reclaimed mines.) <br />2) This permit authorizes all new and existing discharges composed entirely of stormwater associated with <br />mine-waste remediation projects at the mine-waste site. Sepazate permit coverage is necessary to address <br />stormwater dischazges from off-site disposal azeas. <br />3) This permit may also authorize existing dischazges composed entirely of stormwater from any mining <br />operation that is currently covered by an individual CDPS permit for dischazge of process water. <br />b. Definitions <br />1) Stormwater is precipitation-induced surface runoff. <br />2) Mining operations include faclliUes classified as Standazd Industrial Classification Codes 10 through 14 <br />(mineral industry), including active or inactive mining activities. This definition includes operations that <br />have temporarily ceased mining and are in "temporary cessation" slams with the Colorado Division of <br />Minerals and Geology. <br />3) Inactive mining operations aze mining operations that are not being actively mined. <br />4) Mine-waste remediation projects are projects undertaken to reduce or eliminate environmental impacts of <br />mine waste. <br />5) Mine waste, for the purposes of this permit, means any mineral material such as overburden, raw materials, <br />intermediate products, byproducts, fmished products or waste products, which is or has been mechanically <br />disturbed or moved from its naturally occurring location as par[ of a mineral extraction (mining) activity. <br />Examples of mine waste include: mine tailings, which is ore that has gone through a milling process and <br />then been discarded, and waste rock, which is rock that has been moved from its natural location, but not <br />processed. <br />Other Defmitions can be found in Part I.G of this permit. <br />Application, Due Dates <br />a. Application Due Dates: At least thirty days prior to the anticipated date of discharge, the owner (or operator <br />when the owner does not operate the facility) of the facility shall submit an application provided by the Division. <br />
