BASIC PERMS AND CONDTTION -ALL FACII,ITIES (cont.) <br />otherwise provided by the Division, the permittee shall have 30 days after such notification to both make the <br />necessazy changes [o the plan and to implement them. <br />The petmittee shall amend the plan whenever there is a change in design, construction, operation, or maintenance <br />which has a significant effect on the potential for the discharge of pollutants to the waters of the State, or if the <br />SWMP proves to be ineffective in achieving the general objectives of controlling pollutants in stormwater <br />dischages associated with mining activity. Amendments [o the plan shall be summazized in the Annual or <br />Compliance Report. <br />Prohibition of Non-stormwater Discharges <br />a. Except as provided in pazagraph b, below, all discharges authorized by this permit shall be composed entirely <br />of stormwater. Dischazges of water other than stormwater must be addressed in a sepazate CDPS permit issued <br />for that dischazge. <br />b. Dischazges from the following sources that aze combined with stormwater dischages associated with mining <br />activity may be authorized by [his permit, provided that the non-stormwater component of the dischazge is <br />identified in the SWMP (see Part I.B.4.g of the permit): fire fighting activities, uncontaminated compressor <br />condensate, irrigation drainage, lawn watering, air conditioner condensate, uncontaminated seeps and springs, <br />and foundation or footing drains where flows are not contaminated. <br />4. Releases in Excess of Reportable Quantities <br />This permit does not relieve the pennittee of the reporting requirements of 40 CFR 110, 40 CFR 117 ar 40 CFR 302. <br />Any discharge of hazazdous material must be handled in accordance with the Division's Notification Requirements <br />(see Part II.A.3 of the permit). <br />Facility Inspections <br />a. Active Mining Operations. Qualified personnel identified by the operator shall make a thorough inspection of <br />their stormwater management system, at least twice per year (in the spring and fall). Where semi-annual site <br />inspections aze shown in the plan to be impracticable because an employee is not stationed or does not routinely <br />visit the site, inspections as required in this pan shall be conducted at appropriate intervals specified in the plan, <br />but never less than once in two years. These inspections must be documented and summarized in the Annual <br />Report (see Part I.E.1 of the permit). <br />Inactive Mining Operations. Qualified personnel identified by the operator shall make a thorough inspection of <br />their stormwater management system, at least once per yeaz. Where annual inspections are shown in the plan to <br />be impracticable, because an employee is not stationed at or does not routinely visit the site, an inspection and <br />certification is required once every three years by a Registered Professional Engineer that the site is in compliance <br />with the plan. These inspections must be documented and summazized in the Compliance Report (see Part I.E.1 <br />of the permit). <br />c. Remediation Operations. Qualified personnel identified by the operator shall make a thorough inspection of <br />their stormwater management system, at least once per yeaz (in the field season). Where annual site inspections <br />are shown in the plan to be impracticable, because an employee is not stationed at or does not routinely visit the <br />site, inspections as required in this pan shall be conducted at appropriate intervals specified in the plan, but never <br />less than once in two years. These inspections must be documented and sununazized in the Annual Report (see <br />Part I.E.1 of the permit). <br />d. Inspection Requirements -ALL Operations. The inspections as required above must include the following: <br />I) Disturbed azeas and azeas used for material storage that aze exposed to precipitation shall be inspected for <br />evidence of, or the potential for, pollutants entering the drainage system.
