(ACE) is pleased to <br />report that the long-term Flood Control Mitigation Plan for the Durham Pit is on schedule for <br />completion by March 31, 2005. As you are aware this long-term Flood Control Measure was <br />required as part ofthe Division ofMinerals and Geology (DMG) October 27, 2004 Findings ofFact, <br />Conclusions of Law and Order for the Varra Companies, Inc. Mining Permit Amendment. The <br />Findings of Fact stated that the long-term plan would be submitted to the DMG in the form of a <br />Technical Revision by March 30, 2005. Additionally, the Findings of Fact indicated that the long- <br />term plan would be submitted to the applicable local, state and federal flood control agencies by <br />March 31, 2005. As a matter of efficiency, I am requesting that we be allowed to officially deliver <br />the design package (plans and specifications) and Conditional Letter ofMap Revision report to DMG <br />and Weld County during our scheduled meeting at Weld County on April 1, 2005.
