Noun, MD, MPH <br />Faecuve lhrenor <br />I wish to take this opportunity to comment on your letter dated September 7, 1993 and <br />received by me on September 13, 1993. This letter is your notification to the Colorado <br />Department of Health that Delta County has extended the certificate of designation for the <br />North Fork Landfill to include ali of the N 1 j2 of the SE 1 j4 of Section 6, T14S, R92W of <br />the 6th P.M. The extension of a certificate of designation is not a unilateral decision that <br />is to be made by the local governing body having jurisdiction. Section 30-20-103.7(3)(a) <br />C.R.S. reads in part, "Prior to the issuance of a certificate of designation ...the report...shall <br />be...reviewed and a recommendation as to approval or disapproval made by the <br />department...". The solid waste regulations require that pertinent geological, hydrological <br />and engineering and operation data be compiled into an application or technical document <br />for review. The Colorado Depaztment of Health is required, by statute, to have at least a <br />30 day public comment period. The local governing authority is required by statute to have <br />posted the land in question and to have a public hearing (30-20-104(3)b) C.R.S.). The <br />Boazd and the local health department were recently sent a copy of the revised solid waste <br />regulations that parallel the federal subtitle D rule. Please use these regulations in the <br />preparation of your landfill expansion document. <br />I assume that this situation is an oversight in the haste to close two existing landfills and to <br />prepare the third for the increased usage.
