I wish to take this opportunity to comment on your letter dated September 7, 1993 and
received by me on September 13, 1993. This letter is your notification to the Colorado
Department of Health that Delta County has extended the certificate of designation for the
North Fork Landfill to include ali of the N 1 j2 of the SE 1 j4 of Section 6, T14S, R92W of
the 6th P.M. The extension of a certificate of designation is not a unilateral decision that
is to be made by the local governing body having jurisdiction. Section 30-20-103.7(3)(a)
C.R.S. reads in part, "Prior to the issuance of a certificate of designation ...the report...shall
be...reviewed and a recommendation as to approval or disapproval made by the
department...". The solid waste regulations require that pertinent geological, hydrological
and engineering and operation data be compiled into an application or technical document
for review. The Colorado Depaztment of Health is required, by statute, to have at least a
30 day public comment period. The local governing authority is required by statute to have
posted the land in question and to have a public hearing (30-20-104(3)b) C.R.S.). The
Boazd and the local health department were recently sent a copy of the revised solid waste
regulations that parallel the federal subtitle D rule. Please use these regulations in the
preparation of your landfill expansion document.
