Box 100 <br />San Luis, CO 81152 <br />Re: Stormwater Permit Requirements for Industrial Activities <br />Costilla County Landfill Pit <br />Costilla County <br />Dear Mr. Jaramillo, <br />r~ ~3~ , <br />~~ <br />It has come to our attention that you may be engaged in an industrial activity that is included under <br />the stormwater regulations. We have no record that you have applied for or obtained a Stormwater <br />- Discharge Permit for the above-referenced facility. <br />In 1987, the US Congress amended the Clean Water Act to expressly include stormwater discharges <br />from industrial and construction sites as requiring Clean Water Act controls. In 1990, EPA issued <br />regulations that require specific industrial and construction activities to obtain permits in order to <br />discharge stormwater from their facilities. Active and inactive landfills (Standard Industrial <br />Classification Code 4953) are specifically included. The Water Quality Control Division of the <br />Colorado Department of Public Health and Environment has direction and authority to administer the <br />stotmwater permit program in Colorado. <br />Since the above-referenced site is specifically included under the regulations, a Stormwater General <br />Permit for Stormwater Discharges Associated with Heavy or Light Industrial Activity is required. A <br />copy of the application form has been enclosed for your use. The application should have been <br />completed and submitted to our office prior to beginning operations or October 1, 1992, whichever <br />was later. Since activities have already begun, the application should be returned by May 24, 1995. <br />If you feel that a permit is not required for your facility, please contact me to discuss this matter by <br />this same date. <br />Note that the application requires the preparation of a 5tormwater Management Plan (SWMP). A <br />guidance document on the SWMP preparation has also been enclosed. Please submit your SWMP <br />along with your application. <br />
