Findines on Comaletion of the Reclamation Plan <br />RMBT is requesting Phase III (final) release for an approximate 35-acre disturbed area and <br />193-acre permit area, all located in Section 28 and 29, Township 35 North, Range 11 West. <br />The Division reviewed the bond release application and inspected the lands. Based on the <br />review and inspection, the Division finds that RMBT has successfully completed all surface <br />coal mining reclamation operations in accordance with the approved reclamation plan and <br />fully met all reclamation requirements of the Rules and the Act. <br />V. PROPOSED DECISION <br />Based on the findings set forth above, the Division proposes to approve RMBT's request for <br />Phase III bond release for the La Plata No. 1 Mine. This proposed decision will release <br />RMBT from liability for reclamation work in the bond release azea. <br />The Division currently holds a reclamation obligation from RMBT in the amount of <br />$8,730, all of which covers the existing reclamation liability. The Division has <br />previously released $49,470 of reclamation liability in bond release SL-O1, and now in <br />this bond release SL-02 proposes to release the remaining $8,730 of reclamation liability. <br />The Division also proposes to terminate jurisdiction on the lands covered by mining and <br />reclamation permit C-87-072, <br />Any person with a valid legal interest which might be adversely affected by this proposed <br />decision may request a formal public heazing before the Mined Land Reclamation Board in <br />accordance with Section 3.03.2(6). Public notice of this proposed decision will be published <br />twice in the Durango Herald for two weeks as soon as possible. Requests for public hearing <br />must be submitted to the Division in writing within thirty days of the first publication in the <br />Durango Herald. If no hearing is requested within that thirty days, the Division's decision <br />will become final. <br />12 <br />
