Welt: <br />AUG 6 1992 <br />We consider your letter dated June 26, 1992, ae the final report in the <br />monitoring of the Cooper's hawk nest trees, as required by BLM in the letter <br />dated April 26, 1990. That letter granted relief from Special Condition /5 of <br />OSM'e approval document NCO-0021. The provision required that use of the <br />nests be documented during 1990 and 1991, and that neat trees moat be <br />monitored for subsidence-caused damage or mortality for a period of one year <br />after retreat mining had occurred. Your monitoring of these nests indicates <br />that mining and subsequent subsidence did not affect the use of the area by <br />Cooper's hawks, or cause damage or mortality to the neat trees. West Elk Mine <br />has met the requirements of the 1990 agreement, and no further actions on the <br />part of Weet Elk Mine are required. <br />Your cooperation in complying with the monitoring requirements has been <br />appreciated. <br />Sincerely yours, <br />LYHf+I D.
