The Division finds that performance standazds and design requirements of the (renewed) permit <br />will provide for the scope and objectives of general provisions of Rule 4.01. <br />II. Rule 4.02 Signs and Mazkers <br />Signs and appropriate permit mazkers aze erected and in place at the site. An entrance sign in <br />compliance with the Rule is in place, as aze topsoil (topsand) pile signs. Boundary mazkers aze <br />white posts. <br />III. Rule 4.03 Roads <br />A. Haul Roads <br />Hauling of coal, spoil, and coal mine waste has been terminated at the Keenesburg Mine, <br />and there aze no plans to resume hauling of coal, spoil, and coal mine waste. Haul roads at <br />the site have been re-classified to Access Roads. [PAP, Section 2.05.3, page 103.] [Rule <br />4.03.1] <br />B. Access Roads <br />Access roads have been designed, constructed and certified by a registered professional <br />engineer in accordance with 4.03.2. [Rule 4.03.2(1)(d)j <br />C. Light-Use Roads <br />Light-use roads have been designed and constructed in accordance with Rule 4.03.3. Some <br />light-use roads aze permitted to be left in support of approved post-mining land use. [Rule <br />4.03.3(7)]. <br />IV. Rule 4.04 Support Facilities <br />No new support facilities are anticipated on the site. The construction of existing support <br />facilities has not damaged or caused disruption of oil, gas, or water wells or pipelines, coal slurry <br />pipelines, railroads, or utility lines, which pass over, under, or through the permit azea. The <br />Division approved the existing facilities. [Rule 4,04(6)] <br />Three gas wells have been installed within the permit area by a third party. The gas company <br />(Noble Energy Production, Inc.) maintains these well sites and access to the wells. These three <br />locations have been classified as industrial land use. Reclamation of the well sites is the <br />responsibility of the gas company.
