This revision would add the Box Canyon Federal Coal Lease (C-56447) to the active mine <br />permit azea. This letter offers GMI1G consent/concurrence as required by the Surface Mining, <br />Reclamation and Control Act for the Colorado Division of Minerals and Geology (CDMG) to re- <br />vise MCCs permit area to include the Box Canyon lease. <br />While most of the concerns identified by the GMUG have been adequately addressed, we have <br />• worked directly with MCC in resolving some outstanding issues. Therefore, our <br />consendconcutrence is given understanding that the following points will be clarified by MCC at <br />the time final permit approval is completed by CDMG: <br />1. The surface water monitoring location on Box Canyon creek was inadvertently left off <br />Map 34 and Table 5. MCC has ensured us that this will be corrected in the approved permit. <br />2. As part of the agreement between MCC and the GMUG for monitoring Forest Service <br />water resources (Exhibit 19C of the approved permit), MCC has indicated the results of this <br />monitoring will be included in the Annual Hydrologic Reports (AHR). MCC will add ver- <br />biage to the permit to capture this. The GMUG and MSC also plan to update Map 37 in the <br />2000 field season. <br />3. Regazding monitoring the portions of Deep Creek that will be subsided, MCC has agreed <br />to include these data in the AHR, and provide the GMUG with quarterly letter reports detail- <br />ing observ2tions during active mining activity in this area. MCC will revise the permit [o re- <br />flect this commitment. <br />4. MCC has agreed to add vegetation monitoring to their :.pproved Mans for visual subsid- <br />ence monitoing and photographic documentation. MCC will revise the permit to refle:;t [his. <br />5. MCC added wording to page 2.05-123 regazding repair of stream channels.
