M"nae' a. `°ng <br />Division Director <br />1809 Highway 133 <br />Paonia, Colorado 81428-9711 <br />RE: Citizen's Complaint, Bowie No. 2 Mine, Permit No. C-96-083, Bowie Resources, <br />Inc. <br />Dear Mr. Frazier: <br />It is a requirement of Section 5.02.5(4) of the Regulations of the Colorado Mined Land <br />Reclamation Board for Coal Mining (the Regulations) that, within 10 days of a coal mine <br />site inspection that was initiated by a citizen's complaint, this Division must send <br />notification to the citizen and to the alleged violator the following information: <br />On July 21, 1997, the Division received a signed written complaint from Douglas <br />Frazier, alleging possible violations of certain Regulations. The complaint <br />involved dust and flyrock from blasting emanating from the Bowie No. 2 mine <br />site. The Division determined that there was a possibility of imminent harm if the <br />blasting flyrock allegation was true, so an inspection was conducted no later than <br />the next day after the complaint had been received at the Division, as required by <br />Regulation 5.02.5(1)(a); <br />2. Bill Carter of the Division conducted a field inspection at the site of the alleged <br />violations. A copy of his inspection report is enclosed with this letter; <br />3. David Berry and Joe Dudash conducted telephone interviews with the citizen who <br />filed the complaint, the alleged violator and other possible witnesses to the alleged <br />violations; <br />4.
