Criteria <br />Phase I <br />Up to sixty percent of the applicable bond amount shall be released when the permittee <br />successfully completes bacl~lling, regrading, and drainage control in accordance with the <br />approved reclamation plan. <br />The approved reclamation plan for the mine site and the loadout site is described in the Permit. <br />Demolition of stmctures is considered a part of Phase I reclamation by the Division. Retention of <br />permanent structures is also considered equivalent Phase I reclamation by the Division. Drainage <br />diversions, permanent impoundments; and roads aze required to meet certain design criteria as a <br />prerequisite to Phase I Bond Release approval. Written requests by landowner(s) for retention of <br />some of these structures are a prerequisite for such approval of permanent structures in the <br />reclamation plan. The coal conveyor at the loadout site crossed the pre-existing Kaiser -Sievers <br />irrigation ditch, which is located just west, and parallel to, Gazfield County Road 109. Removal <br />of a concrete lining within a segment of this ditch occurred in 1988. <br />Phase II <br />Up to eighty-five percent of the applicable bond amount shall be released upon the establishment <br />of vegetation which supports the approved postmining land use and which meets the approved <br />success standard for cover, meets applicable productivity standards for prime farmlands or <br />alluvial valley floors, or croplands. With the exception of prime farmlands, evaluation of <br />vegetation establishment pursuant to this paragraph is based on statistically valid data collected <br />during a single year of the liability period. However, no more than sixty (60) percent of the bond <br />shall be_released so long.as the-lands to which the release would be applicable areeontributing <br />suspended solids to streamflow or runoff outside the permit area in excess of premining levels as <br />determined by baseline data or in excess of levels determined on adjacent nonmined areas; or <br />until the essential hydrologic functions and agricultural productivity have been reestablished on <br />alluvial valley floors. <br />Support of Approved Postmining Land Use <br />Approved postmining land uses for the North Thompson Creek Mines include unimproved <br />range, pastureland, irrigated pasture, hay land, developed water resources, and wildlife habitat. <br />SL-O5, C-81-025, Mazch 24, 2003 <br />Page 9 of 26 Pages <br />
