PROPOSED DECISION ...................................................................................................... 24 <br />Introduction <br />This document is the Findings of Compliance leading to a Proposed Decision by the Colorado <br />Division of Minerals and Geology (Division) regarding a Partial Phase III Bond Release <br />Application (Application) filed by Minrec, Inc. (Applicant) for reclamation accomplishments at <br />the North Thompson Creek Mines, Permit C-81-025 (Permit). The Application, designated SL-OS <br />(Surety Release OS) by the Division, requested release of $95,612, the remaining bonding <br />requirement on the Permit. By letter of October 29, 2002, received at the Division on October 31, <br />2002, the Developed Water Resources facilities azea and the bases and azeas of four water- <br />monitoring flumes were withdrawn from the Application. The requested dollar amount of the <br />release was not revised in the revision submittal. <br />This document contains (in addition to this Introduction) four parts. These aze: 1) procedures and <br />summer}! of the hond -release process; 2) criteria and schedule for-bond release; 3} observations <br />and findings of the Division regarding compliance with the bond release requirements of the <br />Colorado Surface Coal Mining and Reclamation Act and regulations promulgated there under; <br />and 4) the Division's proposed decision on the request for bond release. <br />Detailed information about the review process can be found in the Colorado Surface Coal Mining <br />Reclamation Act (Act) and the Regulations of the Colorado Mined Land Reclamation Board for <br />Coal Mining (Rules). All Rules referenced within this document aze contained within the <br />Regulations. Extracts from the Rules are in italics in this document. Detailed information about <br />the mining and reclamation operations can be found in the permit application package (PAP) on <br />file at the Division offices, located at 1313 Sherman Street, Room 215, in Denver, Colorado.
