<br />Mid-Term Review <br />Bourg Mine <br />Introduction <br />This document presents the results of the Division's mid-term review of Walden <br />Coal Company's Bourg Mine. This mid-term review was conducted to fulfill the <br />requirements of Rules 2.08.3, 2.06.2(9), 2.06.3(4), 2.06.5(3), 2.06.5(3), <br />2.06.7(5) and 3.02.2(4). <br />Rule 2.08.3 requires that the Division conduct a review of each permit issued, <br />prior to its mid-term (2 1/2 years). Based on this review, for good cause <br />shown, the Division may require reasonable revision or modification of the <br />permit provisions to ensure compliance with the Act and Regulations. <br />Rules 2.06.2, 2.06.3, 2.06.5 and 2.06.7 require that experimental practices, <br />mountaintop removal variances, variances from AOC, and variances from <br />contemporaneous reclamation be reviewed by the Division where applicable <br />during the mid-term review. The Bourg Mine permit does not have any <br />operations under these categories. <br />Rule 3.02.2(4) requires that the Division review the amount of the bond and <br />the terms of acceptance of the bond ever 2 1/2 years. <br />This mid-term review consisted of a detailed review of the Bourg Mine <br />application to identify any items that may have been overlooked during the <br />initial review. The Division also reviewed all subsequent revisions and <br />stipulation responses to ensure that all permit commitments and conditions <br />were being followed. Hydrologic monitoring data was reviewed in conjunction <br />with the review of the application to assess the adequacy of the monitoring <br />plan and discussion of hydrologic impacts. Problems and observations from <br />past inspection reports were also considered. <br />Section I - Comments <br />The Bourg Mine is currently operating at the beginning of Stage V - end of <br />Stage IV. The mining and reclamation has closely followed the terms of the <br />permit application. The East Dump permanent excess spoil pile has been <br />completed. This was completed in the fall of 1984 almost two years ahead of <br />schedule. The two revisions approved during the first half of the permit term <br />did not detail major changes to the permit application. TR No. 1 <br />incorporating the Northgate Loadout, was a part of the original permit <br />application, but due to several unresolved issues was withdrawn and submitted <br />as a technical revision after permit approval. TR No. 2, a blasting plan for <br />the mine, was submitted in anticipation of the necessity to blast. All <br />necessary state and federal approvals have been obtained, however, there has <br />been no need to blast. <br />
