<br />-61- <br />Three other areas of potential renewable resource lands are found within the <br />Maxwell Mine five year mine plan. These are the Apache, Ciruela, or <br />Santistevan Canyon areas. Due to the lack of hydrologic information, as <br />detailed in Section VI concerning ground water and Section VIII concerning <br />alluvial valley floors, the Division must assume that these areas do contain <br />renewable resource lands. <br />Once the stipulations contained in the two above sections and Section VII, <br />iydrologic Monitoring, are satisfied the Division will be better able to make <br />a determination on the existence of renewable resource lands in the two <br />canyons, and what, if any, additional subsidence monitoring is necessary. <br />Until that time, no secondary or retreat mining may occur beneath Apache, <br />Ciruela, or Santistevan Canyons. <br />With the acceptance of the above stipulations by the applicant, the Division <br />finds the proposed operation in compliance with the requirements of this <br />section. <br />XXIY. ~ecial Categories of Mining - Rules 2.06, 4.22, 4.23, 4.26, 4.27 <br />~~ ~ <br />The requirements of this section do not apply to this operation, since none of <br />the special categories of mining will be conducted. <br />XXV. Miscellaneous Compliance - Rules 2.05.6( ). 4.02. 4.12. 4:19. 4.21 <br />No problems were identified with respect to the requirements of these sections <br />during the review. Based on information provided in Vol. I of the <br />application, the operation is in compliance with all the requirements of the <br />above sections. <br />XXVI. Operations on Lands Subject to Limitations or Prohibitions - <br />Rules 2.03.7 and, 2.10 <br />The proposed permit area is not within; <br />1. An area designated unsuitable for mining; <br />2. An area under study for designation as unsuitable for surface coal <br />mining; <br />3. Any lands subject to other prohibitions or limitations; or <br />4. One-hundred feet of the outside right-of-way of any public road. <br />5. Three hundred feet of an occupied dwelling not subject to valid <br />existing rights. <br />The operation is in compliance with the requirements of this section and Rule <br />2.07.6(2)(d). <br />
