-20-
The aerial photographs are available from the Division.
Stipulation No. 5

THE PERMITTEE SHALL VERIFY THE LOCATIONS OF ALL SPRINGS AND SEEPS
IDENTIFIED IN THE PRELIMINARY SPRING SURVEY TF6l0UGH A FIELD SURVEY.
THIS FIELD SPRING SURVEY SHALL INCLUDE A DESCRIPTION OF EACH SPRING OR
SEEP KEYED TO A LOCATION MAP. THE DESCRIPTION SHALL CONTAIN THE
POTENTIAL OR OBSERVED SOURCE OF EACH SPRING OR SEEP (i.e., SANDSTONE
OUTCROP, ALLUVIUM, FAULT ZONE, FRACTURE ZONE, ETC.); THE MEASURED OR
ESTIMATED FLOW RATE OF EACH SPRING OR SEEP; AND THE FIELD MEASUREMENT OF
pH, ELECTRO-CONDUCTIVITY, AND TEMPERATURE FOR EACH SPRING OR SEEP. THIS
SPRING SURVEY SHALL BE CONDUCTED IN MARCH OR APRIL OF 1984, WHEN WEATHER
PERMITS ACCESS TO THESE AREAS. RESULTS OF THE FIELD SPRING SURVEY SHALL
BE SUBMITTED TO THE DIVISION BY JUNE 1, 1984.
Stipulation No. 6
THE PERMITTEE SHALL MONITOR THE FLOWS OF ALL SPRINGS AND SEEPS WITHIN
THE MAXWELL MINE'S PERMIT AND ADJACENT AREAS ON A MONTHLY BASIS FOR ONE
GROWING SEASON (APRIL THROUGH OCTOBER). THE PERMITTEE MAY REQUEST A
REDUCTION IN SPRING AND SEEP MONITORING FOLLOWING THE SUBMITTAL OF THE
DATA OBTAINED DURING THE GROWING SEASON, AND SUBMITTAL OF AN ASSESSMENT
OF THE SIGNIFICANCE OF THE SPRINGS AND SEEPS TO SURFACE FLOWS,
IRRIGATION PRACTICES, LIVESTOCK WATERING, WILDLIFE WATERING, AND
DOMESTIC USE.
The applicant is required by Rule 2.04.7(1)(iii) to
wells within one mile of the permit area. The well
applicant identifies wells adjacent to and upstream
wells north of the Purgatoire River. It is unclear
adjacent to the Maxwell Mine have been surveyed or
areas.
Stipulation No. 7
provide a map locating all
survey provided by the
of the Allen Mine and some
whether the wells in or
if no wells exist in these
WITHIN 90 DAYS OF PERMIT ISSUANCE, THE PERMITTEE SHALL PROVIDE A MAP
SHOWING THE LOCATION OF ALL WELLS WITHIN ONE MILE OF THE PERMIT AREA.
IN ADDITION, THE PERMITTEE SHALL ASSESS THE PROBABLE HYDROLOGIC
CONSEQUENCES OF MINING ON THOSE WELLS.
The Quaternary age alluvial deposits along the Purgatoire River contain ground
water. These alluvial deposits are a major ground water source in the
region. Most of the domestic, livestock, and irrigation wells identified in
the permit and adjacent areas are completed in the alluvium adjacent to the
Purgatoire River. The quality and quantity of alluvial ground water in this
aquifer is dependent on the quality and quantity of water in the river and the
domestic, agricultural, and industrial activities on, and adjacent to the
alluvial body.
