If additional construction material is necessary for development <br />associated with 1:he pilot plant or ancillary facilities (i.e., access <br />road, water pipeline), the designated operator/lessee shall submit an <br />application to the Authorized Officer for authorization to obtain such <br />material if loeate:d on public lands. <br />2. The designated operator/lessee shall locate, handle, and store gas, oil <br />lubricants, and other petroleum products in such a manner so as to prevent <br />them from entering into and contaminating water resources and soils on the <br />public lands. <br />3. The United States of America considers the development of groundwater <br />resources to be necessary and frequently indispensable to effective land <br />management. The United States shall have the first opportunity to file a <br />state water right for any intercepted groundwater. The designated <br />operator/lessee may file for water rights within the lease, only with a <br />written waiver from the District Ptanager. Ttie Bureau of Land t•lanagement <br />concedes the existence of any water right that the Wolf Ridge Corporation <br />and its affiliatE:s may own or control prior to tiie date of approval of <br />this mine plan. <br />4. The Authorized Officer shall be contacted at least 24 hours prior to: <br />a) Surface disturbing construction or maintenance activity <br />b) Commencement of reclamation activity <br />c) Commencement of drilling and logging operations <br />EVAPORATION POND <br />1. The designated operator/lessee will be required to pump and haul waste <br />water from the evaporation pond to an approved disposal site if the <br />evaporation pond reachs or exceeds its Cesign capacity, unless otherwise <br />approved in writing by the Authorized Officer. <br />2. The liners of ttie evaporation pond will be underlain by a minimum of 4 <br />inches of suitable soil material containing at least 95 percent material <br />passing the No. ]0 sieve (ASTt•t E-11 specifications) or other approved <br />method. <br />3. A water-tight catchment basin or other approved method wilt be employed at <br />the outlet of the leak detection system on the evaporation pond to contain <br />any leaked fluids. <br />4, A buffer zone of 15 feet of undisturbed vegetation will be maintained <br />betti+een the toe of ttie fill slope on the east side of the evaporation pond <br />and the edge of the adjacent major drainage. <br />1 <br />
