Cottony <br />Division Director <br />Natural Resource Trustee <br />The Division received your letter dated June 24, 2003 regarding the 3B Enterprises, Deakins Pit, Permit <br />No. M-2001-060. The letter states that Phase II of the mining operation will encroach within 200 feet of <br />ls` Street. A stability analysis was included with the letter demonstrafing that mining within IS feet of <br />the right-of--way fence at a 2h:ly slope will have no adverse affect on 1~` Street. <br />Any change to the mining and reclamation plan must be filed as a revision to the permit. In the case of <br />yow request to encroach within 15 feet from ls` Street, submittal of a Technical Revision (TR) is <br />acceptable. In order for the TR to be filed with the Division, you must submit an application fee in the <br />amount of $188.00 and submit revised mining and reclamation plan maps depicting the proposed mining <br />offset distance from ls` Street. The Division will retain yow letter on file, and once these items are <br />submitted it will be reviewed on the technical issues.
