XVI. Explosives - Rules 2.05,3(6) and 4.08
Information regarding explosives and the blasting plan is presented in Volume
9, Tab 12.
Peabody has submitted a blasting plan detailing the types and approximate
amounts of explosives to be used, control of maximum peak particle velocity,
the blasting warning and site access control procedure, and the unavoidable
hazardous conditions for which deviations for the blasting schedule will be
needed. Peabody has also submitted a plan for recording the required
information for each blast. A copy of the blasting schedule is published
annually in the San Miguel Basin Forum,
Peabody has a current permit from the Colorado Division of Mines to store and
use explosives at the Nucla Mine.
During the adequacy review process for Permit Renewal No. 1, Peabody informed
the Division that blasting and mining activities in Mine Area No. 1 will occur
within 500 feet of the Lower Second Park Irrigation Ditch. The Division
interprets the regulations, specifically Rule 4.08.4 (7)(b), afford protection
to this earthen structure similar to the protection afforded to any other
man-made conveyance structures such as pipelines and waterlines. Peabody
attempted to perform a pre-blast survey of this structure on March 25, 1988.
Due to the poor condition of this ditch because of the lack of maintenance, a
formal pre-blast survey such as that conducted for residences was not
possible. However, photo-documentation of the ditch was provided to give an
indication of the status of this ditch.
Due to the earthen make-up of this irrigation ditch, the Division does not
anticipate blasting vibrations will cause any significant structural damage.
I{ydrologic characteristics will be monitored as detailed previously in this
document at Stipulation No. 3 in Section IV - Surface Water F(ydrology. Any
dimunition in water quantity and quality caused by Peabody's activities will
be remedied by Peabody as addressed on pages 7-63A to 7-638 of Tab 7, Yolume
3. Therefore, the Division specifically approves mining activities to within
300 feet of the Lower Second Park Irrigation Ditch as allowed pursuant to Rule
4,08,4(7).
The operation is in compliance with the requirements of this section.
XVII. Backfilling and Grading - Rules 2.05.3(6), 2.05.3(4), 2.05.4 (2 )(a
Information pertaining to backfilling and grading operations at the Nucla Mine
is presented in Volume 9, Tab 12. Exhibits 12-1 and 13-3 (Volume 10, Tab 13)
show the current and proposed post-mine configuration of the pit areas.
Exhibit 12-5 also depicts proposed post-mining contours; exhibits 12-6 and
12-8 show typical cross sections of the fill in the mined pits,
-27- May 6, 1988
