Lamm <br />Governer <br />August 1, 1985 <br />Mr. Albert Frei <br />Albert Frei & Sons, Inc. <br />11521 Brighton Road <br />Henderson, Colorado 80640 <br />Re: Hazeltine Investment - File No. 77-152 <br />Action Taken at the July 25, 1985 meeting of the Mined Land Reclamation <br />Board <br />Dear Mr. Frei: <br />The Board was scheduled to consider a Notice of Violation, Cease and Desist <br />Order and Civil Penalties for failure to provide additional financial warranty <br />on File No. 77-153 and reason to believe a violation exists for failure to <br />provide the financial warranty for File No. 78-255. Based upon our <br />discussions and the belief that all the performance and financial warranty <br />forms were provided to the Division, I withdrew consideration of these matters <br />from the agenda. <br />Upon review of the files, I have come to find out that you still have not <br />provided the required performance and financial warranty forms. The Division <br />has received the Irrevocable Letter of Credit for each site. I have enclosed <br />a performance warranty and financial warranty form for File No. 78-255 and a <br />performance warranty form for File No. 77-153. I expect you to properly <br />complete the forms for each file and return the forms to this office by no <br />later than August 12, 1985. <br />Once this matter is resolved, I will be able to return the additional bond we <br />hold on File No. 77-153.
