Office of Surface Mining Findings At the Time of <br />Mining Plan Approval <br />1. The Office of Surface Mining Reclamation and Enforcement (OSMRE) has <br />reviewed the operation and reclamation plan portion of the Munger <br />Canyon mine permit application and determines that it complies with <br />the Surface Mining Control and Reclamation Act of 1977 (SMCRA), the <br />Federal Lands Program, and all other requirements of applicable <br />Federal laws. (See Environmental Assessment and Findings and <br />Supporting Documentation.) <br />2. After reviewing the description of the proposed area of the mining <br />plan approval, OSt~lE determines this area is: <br />a. Not unsuitable for mining in accordance with section 522(b) <br />pursuant to section 522(a)(2) of SMCRA. (See Environmental <br />Assessment, Findings and Supporting Documentation. <br />b. Not unsuitable for mining in accordance with section 522(b) <br />pursuant to standards set forth in section 522(a)(3) of <br />SMCRA. (See Environmental Assessment, Findings and <br />Supporting Documentation, and letter of concurrence dated <br />June 24, 1985, from BLM-Branch of Solid Minerals.) <br />c. Not on any Federal lands within the boundaries of any <br />national forest. <br />
