Assistant Secretarial Findings For <br />Mining Plan Approval <br />1. The Assistant Secretary determines that approval of the Munger <br />Canyon mine mining plan including the operation and reclamation <br />plan portion of the permit application, complies with the Mineral <br />Leasing Act of 1920, as amended, the terms of the lease, the <br />Federal Lands Program, and all other requirements of applicable <br />Federal laws. (See Office of Surface Mining Reclamation and <br />Enforcement Findings and concurrence letter dated June 24, 1985 <br />from BLM-Branch of Solid Minerals.) <br />2. The Department has considered the effect of a decision on the <br />mining plan on historic properties in accordance with the National <br />Historic Preservation Act. CSee letter dated April 11, 1984 from <br />Colorado State Historic Preservation Officer.) <br />3. The proposed operation is not likely to jeopardize the continued <br />existence of threatened or endangered species or result in the <br />destruction or adverse modification of their critical habitats, as <br />determined under the Endangered Species Act of 1973 (16 U.S.C. 1531 <br />et seg.).
