Infiormatinn regarding tree proposed <br />annual coal production also is needed. <br />l"he GCA has reviewed the letter dated Feb.15, <br />1951 from Eastside's attorney to Garfield County. We <br />disagree with the conclusions reached by Mr.Lochead in that <br />we do not believe that Eastside has any right to Maim any <br />valid pre-e::isting non-conforming use r~or do we believe that <br />Eastside has the right to any cl.a.~.ms under Garfield County <br />Resol;..rtion No.85-4~. That permit e;:pired nearly a year' ago <br />and Eas~ts.ir_le was a participant in the proceeding where .it <br />was so determined and dial not enter any object.=inns of that <br />time. <br />The GCA has als^ staff-.ed to both the state and <br />CDLln ty that if Eastside desires to operate the rn.ine in the <br />future in the manner that the mine was historically - <br />inclLrdi.ng a prodLction capacity of the historic average - <br />that the GCA would not oppose such an operation and would <br />cooper~.te in securing Eastside a permit to reflect that type <br />of mine permit. <br />The Gr_q has a long history of dealing with the <br />various proposals of Eastside Coal including the power <br />plants at both Harvey Gap and a'1.ong the Colrado River near <br />Silt. The Eastside mine is lor_at:ed in a very ~~ensiti•.~e <br />location near Hsu~vey Gap State F'ar4~. and in the midst of a <br />populated area of our county. the neighborhood surrounding <br />Eastside is growing and present and future residents deserve <br />to I•.:now what. the owners of Eastside propose 'to do with the <br />mint? property. We be7.ieve that it is only fair and equitable <br />for Eastside to so ar.t and to also secure and revise their <br />permits as r"egt.iircd by law. <br />
