The September 23, <br />1985 letter addressed Stipulations 11 and 12 of the Seneca IIW Permit. <br />The Division does not find these responses adequate to resolve the <br />stipulations based upon the following: <br />1) Before pumping water from Pond 006, how will water quality be <br />measured to ensure that the discharge meets effluent limitations? <br />2) Peabody should commit to a periodic inspection schedule to ensure <br />that no water is impounded at Pond 006 until a water right is obtained. <br />3) Peabody should submit to the Division a final pond design assuming <br />that water rights are not obtained by Peabody. <br />4) Peabody should address their proposal to pump the pond, <br />particularly during the interim period between final reclamation of Seneca <br />IIW, and removal (reduction) of the pond. <br />I look forward to your responses, if you have any questions, please contact me. <br />Sincerely, <br />Steven Renner <br />Hydrologist <br />SR/srs <br />6796E <br />423 Centennial Building, 1313 Sherman Street Denver, Colorado 80203 Tel.
