SHELTON, Director
January 23, 1986
Mr. Vern Pfannenstiel
Peabody Coal Company
10375 East Harvard Avenue, Suite 400
Denver, Colorado 80231
Re: Seneca IIW Stipulations 11 and 12 - File No. C-82-057
~r~~
Dear 1:
This letter is in response to a letter dated September 23, 1985 from
Steve Vardiman of Peabody to Anne Baldrige of the Division. The September 23,
1985 letter addressed Stipulations 11 and 12 of the Seneca IIW Permit.
The Division does not find these responses adequate to resolve the
stipulations based upon the following:
1) Before pumping water from Pond 006, how will water quality be
measured to ensure that the discharge meets effluent limitations?
2) Peabody should commit to a periodic inspection schedule to ensure
that no water is impounded at Pond 006 until a water right is obtained.
3) Peabody should submit to the Division a final pond design assuming
that water rights are not obtained by Peabody.
4) Peabody should address their proposal to pump the pond,
particularly during the interim period between final reclamation of Seneca
IIW, and removal (reduction) of the pond.
I look forward to your responses, if you have any questions, please contact me.
Sincerely,
Steven Renner
Hydrologist
SR/srs
6796E
423 Centennial Building, 1313 Sherman Street Denver, Colorado 80203 Tel.
