I have determined that approval of this mining plan modification would not have a <br />significant impact on the quality of the human environment. The environmental analysis <br />prepared by the Office of Surface Mining entitled Suppleme~nai Enniron.mental <br />Assessment for West Elk Mine, Federal Coal Lease C-1362, and noted in the Finding of <br />No Significant Impact (FONSI), describes the impacts that may result from approval of <br />this mining plan modification and its altematives. The FONSI and supporting <br />environmental analyses are included in this decision document. <br />OSM's review of the proposed action did not identify any issues that required resolution <br />via the addition of special conditions to the mining plan modification approval. <br />Publication of four consecutive weekly newspaper notices in the Delta County <br />bxdependent notified the public of the availability of the administratively complete PAP <br />for review. The last publication date was May 11, 2004. <br />The CO-DMG determined that a bond for $12,000,000.00 is adequate for the Colorado <br />Permit C-80-007 associated with this mining plan. The bond is payable to the State and <br />the United States. <br />A chronology of events related to the processing of the PAP and this mining plan decision <br />is included with the decision document. The information in the PAP, and other <br />• information identified in the decision document, has Ueen reviewed by CO-DMG staff in <br />coordination with the OSM Federal Lands State Coordinator. <br />OSM's administrative record of this mining plan modification consists of the following: <br />- the PAP submitted by Mountain Coa] Company L.L.C., and updated through <br />March 18, 2005, <br />- CO-DMG's Proposed Decision and Findings of Compliance for Permit Revision <br />No. 10, West Elk Mine, C-80-007, <br />- the Supplemental Environme~xial Assessment for West Elk Mine, Federal Coal <br />Lease C-1362, <br />- the FONSI for proposed action and alternatives prepared by OSM, <br />- other documents prepared by CO-DMG, and <br />- correspondence developed during the review of the PAP. <br />Attachments <br />
