Long <br />Dinsion Duenor <br />RE: Recent Correspondence & Permit Status, <br />Alexander Pit, Permit No. M-76-032. <br />Dear Mr. Ballode: <br />Please find enclosed, requested copy of recent correspondence from this office to Mr. <br />Knox, San Miguel County Planning Department, regarding the Alexander Pit. <br />During our conversation from 4/9/97, we discussed status of the Alexander Pit permit. <br />The original permit was issued for excavation and processing of construction materials. <br />Changes in land ownership, subsequent to permit issuance, have resulted in cessation of <br />excavation activities. DMG interprets the permit as having active status because <br />permitted activities--material stockpiling and processing--are currently occurring. DMG <br />permit will not be terminated until reclamation is completed in accordance with permit <br />conditions and appropriate sections of the Act, Rules and Regulations. <br />However, if future activities at the Alexander Pit will be limited to processing of imported <br />materials, and will not include on-site extraction of construction materials from their <br />natural occurrences, a DMG permit may not be required. The post mining land use could <br />be revised from "rangeland" to "industrial" for the office/facilities area. Such a revision <br />would require landowner approval. Upon completion of reclamation for all other areas <br />affected by the mining operation, DMG could approve .release of financial warranty, and <br />termination of permit. <br />On 5/27/93, the Colorado Mined Land Reclamation Board issued Notice of Violation <br />(NOV) M-93-017. On 10/20/93, the Board amended the Corrective Action for NOV M- <br />93-017, to order the operator to continue to pursue necessary permits from USFS and <br />Corp of Engineers (COE), allowing use or reclamation of lands administered by USFS and <br />disturbed by the mining operation. Additionally, the operator was to report to the Board, <br />within 30 days of receiving such permits from USFS and/or COE. Please provide <br />description of action initiated by operator and progress achieved toward compliance with <br />the Board Order from NOV M-93-017. <br />
