Long <br /> Division D~reaor <br />RE: San Luis Project, Permit No. M-88-112 <br />Dear Mr. Green: <br />It appears from your phone conversations with James Dillie, Environmental Protectio3 Specialist, on <br />Mazch 19, 1996 that your group, the Costilla County Conservancy District, is having some difficultly <br />arranging a meeting with representatives of Battle Mountain Resources, Inc. You explained to the Division <br />that you would like to have your consultant(s) conduct an inspection of the San Luis Project mine site and <br />discuss shut down plans with their representatives. You mentioned you had a meeting scheduled in the fall <br />of 1995 but, since your consultant arrived too late, the meeting was canceled and you havr; been unable to <br />reschedule the meeting because BMRI has ignored your recent written requests. You called the Division <br />thinking we would be able to convince BMRI to meet with your group and allow you to irspect the site. <br />Colorado Statutes, and the Rules and Regulations, provide for entry upon permitted lands for inspection <br />specifically to the Board, the Office, or their authorized representatives to determine whether the provisions <br />of the Act and the Rules have been complied with (C.R.S. 34-32-121 and Rule 3.2). There aze no <br />provisions in the Act or the Rules that require an operator (permittee) to allow local citizens (or any member <br />of the public) access to the permit azea for any reason. <br />If an inspection is something you feel is necessary, and BMRI agrees, that is between you and the company. <br />If you aze looking for inspection information, you can review this data at the office of the Division during <br />its normal business hours. <br />If you have additional questions, please <br />Sincerely <br />~i~ //~ , <br />H.
