<br />PURCHASE DADEA CONTRACT DOCUMENTS - An enforceable
<br />contract in Nat it ~s ~.vritten evitlence of the purchaseYS acceptance of

<br />of the pumnase order for Ne price stated therein. The Purchase
<br />Grtler Contract includes Ne Bid, bid Schedule, General ConC!tions,

<br />Solicitation Memorandum, including Work Description, maps,
<br />drawings and any Amendments These documents are
<br />complementary, what is called by for any one document shall be as
<br />binding as if called for by all.
<br />In case of a deference between the contract tlocumerns, precedence
<br />shall be given in the following respective order: bid, Bid Solicitation
<br />memorandum, General Conditions, Purchase Order Tenn s and
<br />Conditons, maps and Drawings, Amendments shall take precedence
<br />in the area of the bid document which they modity or clarity. In the
<br />case of any such difference, the matter shall be promptly brought to
<br />the attention of Ne PROJECT MANAGER who will make a
<br />detertninatlon in canting.
<br />WORK - Thc material and/or labor the seller is to famish to the

<br />SUBCONTRACTOR - A sole proprietorship, partnership or
<br />corporation which has a contract with the CONTRACTOR (or the
<br />pertormance of labor at the site of the work regardless of whether
<br />supplying of material is part of such contract, but without contractual
<br />relationship to the purchaser.
<br />SUPPLIER - A sole proprietorship, partrtership or corporation which
<br />over-Ne-counter or under contract famished the CONTRACTOR
<br />material or equipment incorporated in Ne work br otherwise incident
<br />to Ne CONTRACTOR'S pertortnance, but which pertorms no labor at
<br />the work site.
<br />2. CONORIONS AFFECTING THE WORK
<br />In addition to examining the drawings and specifications, completion
<br />schedule, and other instructions, bidders shall visit the site and take
<br />such other steps as may be reasonably necessary to ascertain the
<br />nature and location of Ne work inrJutling average climatic conditions
<br />and Ne general and local mndibons which can affect the worK or Ne
<br />cast thereof. Failure to tlo so will not relieve bidders from
<br />responsibility for estimating propeny Ne difficulty or cost of
<br />successfully pertorming Ne work.
<br />3. AWARD
<br />Award wilt he made with reasonable promptness, by written notice to
<br />the low responsive and responsible bidder whose bid meets the
<br />requirements and criteria set lonh in the Invitation for Bid. These

<br />The GRAND TOTAL PRICE will be usetl for comparing bids only.
<br />a. Combined single limit of SE00,000'.vnY,en cn an

<br />b. Any aggregate will not be less than 57 Million;
<br />c. The ccntrac'cr must purchase additional
<br />insurance if calms reouce the annual aggregate
<br />below 5600,000;
<br />d. The State of Colorado must be named as
<br />additional insured on each comprehensive
<br />general liability policy,
<br />e. Cerdficates of insurance must be prowdetl to the
<br />State within 10 working days after receipt of
<br />Award: and.
<br />f. Insurance shall inc!uCe provisions providing
<br />notlficatlon to the State 10 days poor to
<br />cancellation of the coverage.
<br />Automobile Liability (Minimum). The contractor must carry
<br />a minimum bf 5600,000 combined single limit.
<br />The State of Colorado MUST be named as an Addi6'onal Insured on
<br />the certificate of insurance. An Additional Insured Endorsement
<br />amending such policy or policies must he presented to the DMG prior
<br />to issuance of the Notice to Proceed. Bidders are advised to
<br />consult with their insurance cami¢r concerning these
<br />requirements. Submit a bid ony if you are prepared to complete
<br />these requirements.
<br />5. WORKSCHEDULE
<br />After a Purchase Order has been issued, the PROJECT MANAGER
<br />will notify the Contractor. Under no circumstances Shall the
<br />CONTRACTOR hegin work Detore a P.O. is issued. It the Bid
<br />Solicitation Memorandum specifies project dates or a certain project
<br />schedule, Ne successful Didder shall pertorm the work during Ne .
<br />spetlfied time Denod. DMG reserves the right to cancel the Purchase
<br />Order if Ne Contractor fails to begin the work as scheduled.
<br />6. ACCIDENT PREVENTION AND SAFETY MEASURES
<br />The Contractor shall comply with applicable provisions of OSHA Part
<br />1926, Construction Standards and Interpretations, in effect on Ne
<br />date of Ne Bid Opening. The Contractor shall continuously maintain,
<br />at his expense, adequate protection of me work and the Principle
<br />Representative's property, and shall take all practicable precautions
<br />in the interest of satery.
<br />Any shafts which were fenced prior to construction adavities shall be
<br />protected by a temporary fence during non-working hours, without
<br />relieving Ne Contractor of ifs legal or conlracNal duties to take safety
<br />precautions. Other openings may be designated by the Protect
<br />Manager as requiring fencing due to pro>amiry of houses or visitation
<br />by tourists.
<br />Work may involve activities around unorctected haiardous mine

<br />unstable layers of surfictal materials or rock. The Contractor shall be

<br />Failure to rnmply will be cause for immediate suspension of Ne work.
