SPECIAL STIPULATIONS
Federal Coal Lease C-01538
Sec. 15. Stipulations (a), (b), (c), and (d) may be waived or reduced in scope if circumstances change
or if the lessee can demonstrate that its operations can be conducted without causing unacceptable impacts
on the concern(s) identified. Exceptions to stipulation (a) in any particulaz year must be specifically
approved in writing by the authorized officer. Subsidence is excluded from the term 'surface-disturbing
lease activities.'
(a) Threatened and EndanEered Species. Jn order to protect important seasonal habitat for the
peregrine falcon, the lessee will be allowed to conduct surface-disturbing lease activities only from July 1
to Mazch 15 on the leased lands described below:
