Pit mined between 1978 & 1980. <br />2. Colorado Yampa Coal Company (CYCC) requested variance from <br />Contemporaneous Reclamation in Permit No. 79-177 to allow for <br />development of underground mine. <br />3. Office of Surface Mining (OSM) approval document stipulated that a <br />specific plan would have to be submitted for underground mine by <br />December 31, 1980 in order to grant the variance. <br />4. A preliminary plan for underground development was submitted in <br />satisfaction of that stipulation in December, 1980, <br />5. In April, 1983, Permit No. C-056-82 was issued to Twenty Mile Coal <br />Company. A variance from Contemporaneous Reclamation for the Entire <br />Area 2 pit was approved to allow for facilities and waste disposal. <br />6. In September, 1984, Division approved a technical revision which <br />entailed waste disposal immediately west of the facilities, rather than <br />in the far western end of the pit. Since the western end of the pit <br />was no longer going to be utilized by Twenty Mile, the approval <br />stipulated backfilling of the western portion of the pit by March, 1985. <br />7, In December, 1984, CYCC submitted a comprehensive grading plan for <br />backfilling several non contemporaneous areas at Eckman Park and Mine 1 <br />and Mine 3 during 1985. The plan called for completion of grading in <br />the designated portion of the Area 2 Pit by October 8, 1985. <br />_ 8. Asa result of the December, 1984 letter, and a subsequent letter <br />of July, 1985, which included reclamation bonding calculations, CYCC <br />reassumed reclamation responsibility for the western portion (that <br />portion not to be used by Twenty Mile) of the Area 2 Pit. A revised <br />Bond was submitted in September, 1985. However, this responsibility <br />was never officially revised through technical revision by either <br />Twenty Mile Coal Company or Colorado Yampa Coal Company. Officially, <br />the obligation still lies with Twenty Mile Coal Company. <br />Twenty Mile Coal Company has subsequently submitted a revised permit <br />application in which the pit section in question has been deleted from the <br />proposed permit area. <br />423 Centennial Building, 1313 Sherman Street Denver, Colorado 80203 Tel.
