Your consideration and specific recommendations or comments regarding <br /> the above is requested. A reclamation timetable should be described which <br /> specifically answers Rule 2.12(5) (f) (i) . <br /> 4. Please describe and illustrate the proposed construction specifications <br /> for the replacement irrigation ditch for Dry Creek No. 2 Ditch. Please <br /> describe how the proposed replacement ditch will function to adequately and <br /> efficiently route irrigation water around the affected land. Additionally, <br /> since the ditch is located within 200 feet of the affected land, a written <br /> agreement must be provided, between the owners of the ditch and Flatiron <br /> Sand and Gravel Co. , that damage to the structure will be compensated for by <br /> the operator (refer to Rule 1.56(5) in the Rules and Regulations) . <br /> 5. The proposed flood control berm is not a permitted feature to the <br /> proposed operation, and is already in place. The Board may or may not consider <br /> this within their domain of responsibility. Regardless, some discussion <br /> is probably warranted regarding the possible effects of shifting flood waters <br /> east of its historic levels. The Colorado Water Conservation Board may be <br /> able to assist you in this area. <br /> 6. Please verify our agreement reached during the inspection of the site <br /> (3116182) that Boulder County's stipulations are to be considered as <br /> incorporated into the application as submitted to the Division. <br /> 7. Since Boulder County has restricted the operation to the first two <br /> stages, please submit an alternate plan for the proposed western bank of the <br /> pond as planned in Stage 1. Per our agreement reached during the inspection <br /> (3116182) , slopes would be steeper on the western banks of the proposed <br /> ponds, however, would not exceed 3:1 slopes as defined in Rule 6.1(f) . <br /> 8. Please provide a seed mixture which will emphasize native short grass <br /> plains species. The present seed mixture contains many mid- to tall-grass <br /> species, and per the inspection of 3116182, concerns were expressed that <br /> taller grasses may post a fire hazard to nearby residential areas. <br /> 9. The Colorado Division of Plater Resources is presently reviewing the <br /> application. We have not received their comments to date. However, they <br /> will be forwarded to your office as soon as they are received. <br /> 10. The Colorado Division of wildlife's report is enclosed. <br /> 11. Please give a more detailed breakdown of the proposed costs of reclama- <br /> tion. Please include per unit costs and specific units for which costs apply <br /> in order to allow the staff the opportunity to assess the reasonableness of <br /> the total anticipated costs for reclamation and surety. <br /> 12. The Mined Land Reclamation Board will consider this application at the <br /> April 21-22, 1982 Board meeting. Please submit all necessary proofs of <br /> publication and notification to adjacent landowners, prior to that time. <br />
