Stage 6 of that land is an area we currently <br /> need to commence activities in and subsequently mine. The correspondence from your offices <br /> in 1989 indicated that we could not commence activities in this area until an agreement was <br /> reached with the ditch company. We or our landboard have been in touch with the ditch <br /> company and a copy of a tentative agreement, of which a copy is enclosed was submitted to <br /> them in August 1992 and there has yet to be a decision on their part on the ditch and our <br /> desire to relocate as part of the mining. <br /> As you indicated the intent of the statement in the 1989 correspondence was to assure the <br /> agreement of parties, when our operation approached the 200 setback form man made <br /> structures. This being the case it is our understanding that we can enter stage 6 immediately <br /> and that such entry will be in full compliance with our permit so long as we do not approach <br /> any closer than 200 feet from the ditch in our mining operations. <br /> Should you have any questions or wish to add to our discussion please feel free to do so. <br /> Sincerely, <br /> )John F.
