JIM TATUM
ATTORNEY AT LAW
Telephone (719) 846.0149 Facsimile (719) 846-0159
R~CE~i/ED
MAY 1 ~ ~`
May 11, 2004 pivisien of !dlinerals and GeoloOY
Mr. David Berry Facsimile transmitted (303) 832-8106
Colorado Division of Minerals & Geology
1313 Sherman Street, Room 215
Denver, Colorado 80203
RE: Basin Resources, C-81-013
Mr. Berry:
Please forgive me if my cynicism and perhaps sarcasm shines through; after all, it
has only been 14 years of time and three lawsuits to drag Basin to a position of
responsibility and seemingly overlong and repeated efforts by your agency to take the
side of industry against its victims.
How many years of delay did we go thru with your agency claiming that Methane
would not kill vegetation at the same airshafr site? Now it is well documented and we
see wide-spread destruction of grass and vegetation on our property and other close
properties. Yet your people adamantly denied the facts.
How many more years of delay, requiring 2 full-blown trials, did it take to get
some responsibility for subsidence. Your guy Pendleton did everything he could do to
subvert justice. Much dishonesty was revealed in the two trials.
It required yeazs and 2 trials to pierce the perjury that the airshaft was cased and
responsible for draining the water formation for our water wells. It seems to me that your
agency didn't do much to protect the citizens. We saw ridiculous excuses citing water
rights, etc. that were completely inapplicable used as justification.
What input did the citizens have on the technical revision - no body who has any
experience with wells and casing would remotely state that the grout will permeate thru
the perforations and pea-gravel and seal off the water zones (which are now depleted).
Halliburton or any other truthful source will not tell you they can guarantee a seal under
these conditions so please do not try to obfuscate the issue with terms like "high yield
concrete, etc".
129 North Commercial Street Trinidad, Colorado 81082
