On August 26th <br />I met with John Nelson, Jim McArdle and Dave Buckram to discuss this and ask for <br />clanficatiores as to what was paid and what wasp k paid on my invoices. They could not explain <br />at the time, as rt proved to be unclear to them also. I later received to the malt; copies of my <br />invoices marked up and a spread sheet of line items that did not add up. These documents <br />cannot be interpreted, but it appears that none of the hourly equipment rental that ocaured <br />after June 14 was paid Also all of the retauuige on this job is still being held <br />Response: John Nelson, Jim McArdle and Dave Buckram did not have all the necessary <br />information available at the meeting with the contractor to thoroughly discuss all amounts <br />paid on the contracture's invoices. The State is clear on what was paid on each invoice and <br />why. The CONTRACTOR has never brought to the State's attention any errors in the <br />spreadsheet or questions on bills. <br />The CONTRACTOR'S retainage bill was received November 25, 1994 and is currently being <br />processed. <br />Item # 2 Amount - Sl <br />Two hours TD-2S dozer at $90.00 per hr. to slope the new road through the north end 2% into <br />the hill This regrwes a change order as it was not required in the Bid Documenu or Contract <br />I have asked for a change order on this but it was denied, and as of yet it is unbilled CWL was <br />asked verbally to do this and again in the final inspection and certification of completion form. <br />The original road through this area had no particular slope in or out. It was just a rough mine <br />rand full of ruts and rocks <br />Response: The Bid Invitation Special Conditions, Task 8-North End Backfill and Grading, <br />specifies that "Upon completion of the backfilling and grading, the access road to the <br />Monarch Fan shall be reestablished as staked by the Project Manager and as indicated on <br />Map 7." Prior to road construction, the PROJECT MANAGER duected the <br />CONTRACTOR to slope the re-established road through the north end 2 percent into the <br />hill. The CONTRACTOR was informed of the 2 percent grade requirement during the <br />survey work on April 22, 1994 during the time that Harry Ranney of the Division, the <br />Project Manager and Preston Mease were doing the survey on the North Slope for road <br />alignment. In fact, CWL.'s instrument was used during the survey. <br />8 <br />
