<br /> <br />CWL REQUEST FOR PAYMENT <br />Item 1 Amount 56x236.61 ~tv1k'L `r ~~A <br />This claim is for line items and retairu{ge billed to date but as yet unpaiQ and for hourly <br />equipment rental for additional work T fiis howly equipment rerUal time was used (a) to move <br />three piles of topsoil; (b) to rip the areas that these piles were on, and (c) to move some brush <br />on the East side of the East Pit. These three piles of topsoil are identified as Chen's Hill North <br />Pile, the East Pit Yard Pill and the East Pit west side additional topsoil pile. <br />The Chen's Hill North Pile was addressed in a letter from DMG dated May 10, stating that this <br />pile was not included in the lump sum topsoilir;g pnc~ CWL was asked to move this using <br />hourly equipment rental CWL has not been paid fully for this. <br />Response: There is no breakdown in the CONTRACTOR's claim as to what chazges <br />constitute the total of $56,236.61. The OWNER is currently holding retainage of $32,900.67. <br />Machine time to move the Chen's Hill North Pile began on June 9, 1994 and continued until <br />June 15, 1994. A total of 5 hrs (D-7) time ($375.00), 40 hrs of Cat (TD-25) time ($3600.00), <br />and 43 hrs of scraper time ($6975.46) were used. One additional day, July 7, 1994, of <br />machine time was used to cover minor baze spots on the northeast side of Chen's Hill (7 <br />hrs TD-25; 9 hrs scraper). The machine time from June 9 to June 15 was reflected in CWL <br />Invoice 5 dated 6-26-94 and was paid. Machine time for July 7 included 9 hrs of scraper <br />($1459.98) and 7 hrs of TD-25 ($630.00) was reflected in CWL Invoice 6 dated July 24, 1994 <br />and was paid.) <br />The East Pit Yard pile was a small pile near the East Pit and was not identified to the contract <br />documents. It didnY become evident to them that it was topsoil until near the very end of the <br />job, when CWL indicated this to DMG. DMG then told CWL to spread this using equipment <br />rental CWL has not been paid for this. <br />Response: Machine time to move We East Pit Yazd Pile was only for the D-7 and TD-25 <br />cats and consisted of 6 hrs (TD-25) ($540.00) and 5 hrs (D-7) ($375.00) all on June 29,1994. <br />This machine time was included in the CWL Invoice 6 dated July 24, 1994 and was paid.) <br />The third pill the East Pit West Side additional topsoil, was not identified in the contract <br />documents to be replaced under the lump sum topsoiling prices. Task 4 "Chen's Hill topsoil <br />replacement ; Task 7 "West Slope topsoil replacement ; arul Task 9, "North End topsoil <br />replacement ;state that "If project manager requires additional topsoil to be brought in from the <br />east Pit site, this cost will be paid separately, and will be based upon the Equipment Rental <br />rates. " The East Pit West side additional topsoil, was the only other topsoil available to which <br />this reference could apply. <br />6 <br />
