Brown: <br />Xour representatives are correct Chet 7 visited the GEC reclamation <br />site. The rest of your statements concerning that visit are incorrect. <br />The contractor was working on part of the East Pit in the wrong sequence <br />according to the Contract, and he was pushing topsoil into the Pit <br />without saving 'it ae required by CIEs Contract. When I told Mr. Nelson <br />of these concerns he wfls uncoucerned and did not have an' appropriate <br />response. As a matter of fact, I have complained since to the Division <br />with no response. Topsoil. is still being lost, particularly now being <br />mixed with boulders and too much rock subetreta. <br />Next, 1 informed Nr. Nelson that the dozers did not have the required <br />safety equipment such as backup alarwa. Nis reply was that !'the <br />operators have . juot .gotten tired .of listening to them and have . turned <br />them otf". At my urginp,, Hr. Nelson stopped one dozer. only to leas <br />that the alarm vas not in operating conditi.nn. 1 stopped the second <br />dozer that dial noC have sit alarm. At this point rir. Nelson's only <br />comments were wlgaricles. Leecr, I asked lir. Nelson if he wished to <br />inspect the dozers. He said "you do it". That vas the only time that I <br />climbed on a mocitinc. S}~ou].d I not do what rir. Nelson said for me L'o <br />do? The doaer operator acid that he vas not wearing his seatbelt. <br />Iaterferenee, dangerous? Nou can insistence for safety he defined that <br />way? I am willing to assume liability.for my safety. Please note that <br />I was the only individual on the site in compliance with OSHA <br />requirement for a hard hat. When you take your legal steps, it will <br />matte interesting testimoay.ttwc your representatives are not interested <br />in safety ralea end that "efficiency and timclyness" are more important <br />than safety. <br />Since my previous efforts to request the best saving of the topsoil. have <br />fai].cd, I am making this a formal complaiuc tlu3t the Division's ow <br />regu]etions for the saving of topsoil are not being met. 1'iLeL•e is also <br />no compaction in lifts of material being dozed into the Eas[ Pit.
